Wisp is a private, end-to-end encrypted messenger published by Codelio, a company registered in France ("we", "us"). By creating a Wisp account or using the app, you agree to these Terms of Service and to our Privacy Policy. If you do not agree, do not use Wisp.
You must be at least 13 years old (or the higher minimum age your country requires for consenting to the processing of your data) to use Wisp. You must register with a phone number you are entitled to use. You are responsible for keeping your device, your PIN, and your backup passphrase safe — because of end-to-end encryption, we cannot recover them for you.
Messages and calls in Wisp are end-to-end encrypted. We cannot read, listen to, moderate, or restore your content, and we claim no ownership of it. Your conversation history is stored on your device, not on our servers; if you lose your device without a backup, your history is gone and we cannot bring it back. You are responsible for what you send.
Privacy is not a license to harm others. When using Wisp you must not:
Anyone can block any contact, and message requests from people outside your contacts are held until you accept them. You can report spam or abuse directly from a conversation; a report sends us the reporting context you choose to share, never your message history. If we determine that an account violates these terms — from user reports or from abuse signals visible to our servers, since we cannot see message content — we may limit, suspend, or delete that account, immediately in serious cases. We enforce these rules with all reasonable endeavours, and we cooperate with authorities when the law requires it.
Wisp is provided free of charge. We work to keep it available, secure, and up to date, but like every online service it is provided "as is" and "as available" — we cannot promise it will be uninterrupted or error-free. We may add, change, or remove features, and we may discontinue the service with reasonable advance notice. Old versions of the app may stop working when the protocol or our servers change; keeping the app updated is part of keeping it secure.
We intend for Wisp to interoperate with third-party messaging services (such as WhatsApp) in the European Union, under the Digital Markets Act. If and when such a feature launches, it will be strictly opt-in, messages exchanged with third-party services will remain end-to-end encrypted, and these terms and the Privacy Policy will be updated with the exact details before you can enable it. Chatting with users of a third-party service is also subject to that service's own terms on their side.
You can stop using Wisp at any time and delete your account directly in the app (see how to delete your account). Deletion removes your account data from our servers immediately. We may suspend or terminate accounts that violate these terms, as described in section 5.
Nothing in these terms excludes or limits liability that cannot be excluded under applicable law — including liability for intentional fault, gross negligence, or personal injury. Subject to that, we are liable only for direct damage caused by a breach of these terms that is attributable to us, and not for damage caused by circumstances outside our reasonable control, by your breach of these terms, or by the loss of content we never had access to (such as end-to-end encrypted history lost with a device).
If we change these terms, we will update this page and the date at the top. Material changes will be announced in the app before they take effect; continuing to use Wisp after they do means you accept the new terms. If you do not, you can delete your account at any time.
These terms are governed by French law. If you are a consumer in the European Union, you also keep the protection of the mandatory consumer-law provisions of the country where you live, and you may bring disputes before the courts of that country. The European Commission's online dispute resolution platform is available at ec.europa.eu/consumers/odr.
